Abstract: Examines concerns that Australia's attempts to exercise jurisdiction over whaling activities in sector of Southern Ocean generally regarded as high seas could significantly destabilise Antarctic Treaty System by reviving frozen territorial claims. Includes examination of legal foundations of Humane Society International Inc. v Kyodo Senpaku Kaisha Ltd case; and evaluation of exercise of Australian jurisdiction in light of applicable international law.
