| Abstract: | Analyses present relationship between regional and global legal regimes affecting Southern Ocean, with particular reference to pollution from vessels, and argues that Antarctic Treaty System alone is insufficient to deal with such pollution. Review of legal framework includes municipal law of claimant and flag states; 1982 United Nations Convention on the Law of the Sea (UNCLOS) and 1973 International Convention for the Prevention of Pollution from Ships (MARPOL); and provisions of Antarctic Treaty System. Discusses ways of overcoming parallelism in regional and global governance in context of 1991 Environmental Protocol to Antarctic Treaty, and 2005 Liability Annex. |
