Abstract: | Explores legal regime for bioprospecting in Southern Ocean, and assesses its adequacy to deal with bioprospecting activities. Discusses various aspects of both customary and legally binding international environmental law from 1972 Stockholm Declaration to 1992 Convention on Biological Diversity, with particular reference to UN Convention on the Law of the Sea's recognition of resource sovereignty over water column, seabed and subsoil. Examines roles of coastal and flag states in regulation of bioprospecting; potential effect of territorial claims in Antarctica; present legal vacuum and need for certainty; and scope of any possible legal mechanism for regulating bioprospecting. |
