Abstract: | Compares ethical framework of bioprospecting with issues discussed as part of CRAMRA minerals prospecting negotiations in 1980s. Outlines changes in funding of scientific research which blur distinctions between academic and commercial, and argues need for wider community to impose more customary ethical framework on bioprospecting to deliver equitable and environmentally sensitive outcomes. Discusses moves to adopt relevant provisions of Convention on Biological Diversity (CBD) as framework for Antarctic bioprospecting regime; 2002 Bonn Guidelines and implications of sovereign state control of genetic resources for benefit sharing or biopiracy; and likely effects of US non-ratification of CBD. Examines conditionalities of intellectual property rights, including issues of disclosure, benefit sharing, and patent laws incorporating compulsory licensing. |
