Abstract: Outlines legislative background to management policy for Patagonian toothfish and mackerel icefish in Australian waters around Heard and McDonald Islands in Southern Ocean. Describes threats to sustainability of fisheries, marine and terrestrial ecosystems caused by illegal, unreported and unregulated fishing vessels. Discusses possible multi-dimensional approach to enforce compliance, including improved fisheries patrols, port state and market controls with effective trade certification and documentation scheme, and powerful enforcement provision to act as deterrent. Assesses enforcement role of Australian Navy; enforcement provisions of CCAMLR and 1994 Doughnut Hole Convention; problems of international law and unregulated vessels of third party States fishing on high seas; status of Regional Fisheries Management Organisations; legal action under UN Law of the Sea Convention; CCAMLR and CITES trade controls; and eco-labelling schemes.
