Abstract: Conflict between Saami and Swedish landowners in Jämtland and Härjedal is old. Government is passive. In beginning of 1990 some forest companies and landowners went to court, to confine Saami winter grazing to village boundaries. Compromise with companies in 1993 allowed grazing with reduced herds but landowners did not agree. In 1996 District Court denied Saami winter grazing rights, reversing burden of proof, so that Saami had to prove continuous grazing since 1800. Appeal will probably end at Supreme Court. Saami have no funds to cover, while landowners have insurance up to $6M.
